A
(writ of) mandamus is an order from a court to an
inferior government official ordering the government official to properly
fulfill their official duties or correct an abuse of discretion. (See, e.g. Cheney v. United States Dist. Court For D.C. (03-475) 542 U.S. 367 (2004) 334 F.3d 1096.)
Rules
on mandamus and similar orders vary by jurisdiction. In the federal courts, these
orders most frequently appear when a party to a suit wants to appeal a judge's
decision but is blocked by rules against interlocutory
appeals.
Instead of appealing directly, the party simply sues the judge, seeking a
mandamus compelling the judge to correct his earlier mistake. Generally, this
type of indirect appeal is only available if the party has no alternative means
of seeking review.

1) NEVER admit to ever doing any drugs even as a kid or
in college, including marijuana.

or past relationships including emotional
4) NEVER let them in your house if they don't have a
warrant or court order
5) NEVER sign any paperwork
6) NEVER let them speak to your children without a lawyer
present and a recording device
7) NEVER speak to them without a recording device or
alone. Always have a witness.
8) NEVER answer leading questions
9) NEVER admit to mental health or other disabilities
10) NEVER do a psych evaluation with DCS/State doctors
11) NEVER think they are your friend.
12) Never use a court appointed atty.
13) Never allow CASA to get involved in your case
14) Never go alone to meetings, visits, court
15) Do not permit conference calls unless everyone
listening identifies themselves and write down who they are. Do not permit caseworkers to use cell phones
during a visit with you or your children.
16) Be polite but assertive when dealing with CYS
employees. Educate yourself, know your
rights and do not back down to their intimidations.
17) If you are treated rudely or threatened by your
caseworker, report them. Chain of
command is the caseworkers supervisor then the director then the county
commissioners, then Dept of Welfare.
18) Never permit in chamber chat sessions during
your court proceedings. Demand that
everything occur in the open. I would
also ask for any caseworker or CYS person giving testimony to agree to forgive
immunity. That way if they lie they can
be held accountable.
The ALWAYS for Parents Dealing with CYS
The ALWAYS for
parents dealing with CYS:
1) ALWAYS do independent drug tests on the SAME day they
give you a drug test.
2) ALWAYS do an independent psych evaluation
3) ALWAYS have all paperwork and communication delivered
to CPS via a professional so a paper trail exists of your communication
4) ALWAYS require tracking and read receipts on
electronic communication
5) Always use email whenever possible for the paper
trail. CC the supervisor. Phone calls can lead to lies.
6) Have your children examined by the family Doctor to
prove there were no abuse marks, sickness or health problems. If there is a medical issue make sure they
document it.
7) Always start a Timeline journal. After each visit write what occurred and email
caseworker a copy.
8)Notify relatives and friends who would be willing to
take kinship or guarianship
9) Read any
and all documents they give you carefully.
Make changes to any and all mistakes and make sure they are
corrected. Ask for a copy of the corrected
paperwork and anything they have documented.
Getting your records or file is your right but they will make it
difficult to attain. You may have to
have an atty file an order to get the file.
Keep copies of everything you have and keep one set of documents off
site safely.
10) Let their phone calls go to voicemail so you can
be prepared and calm when returning the call.
Remember social workers and other government employees may be SUED
for deprivation of civil rights under 42 U.S.C. 1983 if they are named in their
"official and individual capacity."
There is no Immunity if the caseworker took actions with malicious
intent to cause deprivation of rights, or they violated established statutory
or constitutional rights. A supervisor
or director can be liable also if he told to, order to, set in motion of, acts
by the social worker and or refused to terminate a series of acts by the social
worker which they know would cause the violation of constitutional rights.
Parents have the right to care for have custody of
and nurture their children. It cannot be
denied without violating fundamental principles of liberty and justice which
are the base of all our civil and political institutions. It is a right protected by the 1st,5th, 9th
and 14th amendments.
Stolen Children
Three years ago today me and my dear friends Vera and Bill walked into dependence Family court. Just to sit there helpless and listen to the most evil corrupt judge Webb and State Attorney Jennifer Barbookel and Guardian of litem Attorney and a bunch of sick DCF case workers, As Vera and Bill and there daughter fought so hard to get her children back with DCF demands she did to case plans and saying she is to mental really can't be to mental she worked hard to get her babies back. Well if anyone knows DCF they love to make you look bad on paper their agenda is while you are working hard to get your kids back there setting up to take your rights away so they can sell your children. Vera and Bill are the grandparents wonderful good abiding citizen that loves their family with all their heart and soul and went for adoption passed everything two home studies new home everything the children need spent Thousands of dollars attorney fees but doing that they placed the children in a prospective adopted home usually DCF has their sick minds made up your not getting your family back. DCF will pull anything dirty they can let me tell you they put so many lies on paper to steal children and sell them to stranger why because it is a billion dollar business they don't get the Federal money don't believe it look it up they don't make money giving back to family it clearly states in the law family first. They have destroyed this loving family heart sick everyday missing the kids over the love of money Foster and Adoption because its turned right into a very evil corrupted business destroying children and families all over the world and in our own back yard. You know the hole family step up to help Vera and Bill certified letters to DCF telling them they will take the children. Because you see they never look for family and they say they do that is a lie they don't so you can prove it when they say they looked for family and did not. So the day in court DCF and judge webb denied her brother which is a Foster care provider and judge webb had the nerve to use and old home study and discovery instead of the new ones and attorney fees he would not what so ever let his attorney speak so she could show the new home study and discovery and continue for another day. So when he denied her brother They all acted like they just won the lotto right in front of the grandparents as if they were nothing and the sick adoption fake parents were there that was a very sad day. People will say must have done something wrong for this to happen that is a big NO its about money and power. They destroy the children Vera and Bill had to pay so much an hour to be able to see their grandchildren and watched by case workers and would not ever bring the little grand son because they would tell Vera and Bill its not in the child best interest that they would never see him again. How sick is this system but they could see the girls and they loved there grandparents and then to be snatched away a month later and adopted out. Poor children never get to see the ones that took care of them since birth and stolen from the grandparents that they love so much it just destroys your life. The community needs to get angry step up and stop these monsters there still going strong. So much more to this story and so many others to tell I know I had to fight them as well.

We the people are informing you ________________(Senator, Congressman, whom ever we are sending letter to) that Children and Youth Services is acting outside of the law. As your constituent, we are asking you to immediately investigate the illegal removal of our children and the continuous corruption that is being allowed as our children are being monetized.
This corruption is being perpetrated through every level of government. Law enforcement, court personnel, judges, and agencies that have a contractual capacity with CYS (group homes, foster homes, etc.) fall in step with CYS, kidnapping children from loving families without a court order or warrant. At the same time, children who need protection are being forgotten as this system pursues cases that will create the greatest income.
Children under state care have a greater risk of being hurt, abused, or killed than the general population. Families across the country are crying out for justice as their children are abused by the very system that was meant to protect them.
We demand accountability including an understanding that every individual involved is NOT protected by immunity when they break the law and will be prosecuted to the fullest extent of the law. We further demand that financial compensation be awarded to every person that has been caused harm by the actions of CYS.
This is not a political issue. This is a societal issue that affects our communities when children and families are traumatized. This trauma leads to outcomes that fill our prisons, homeless shelters, and mental health facilities.
As our elected representative, we ask you to step up and protect the citizens of our state and country. The children in our communities need immediate resolution as their lives are held hostage by an ineffective and broken child protection system that does more to harm children and families than help.
