Juveniles Abused in Residential Facilities to get More Protection

A bill that would make it easier for young people abused in residential facilities to hold those institutions accountable in court is one step closer to becoming law.

The U.S. House of Representatives onMonday unanimously passed the Justice for Juveniles Act, said U.S. Rep. Mary Gay Scanlon, Democrat-Delaware County, who introduced the measure.

“We have an obligation to protect the wellbeing of all children,” Scanlon said. With the passage of the bill, which will now move to the Senate, she said “we are one set closer to protecting children in corrections facilities.”

The bill would eliminate obstacles for young abuse victims tofile lawsuitswhile they are still detained in facilities by exempting people under the age of 22 fromthe requirements of the 1995 Prison Litigation Reform Act. That act intended to deter prisoners from filing “frivolous” lawsuits, Scanlon said, but does not take into consideration that incarcerated young people have a higher chance of being abused in facilities, or the difficulty youth face in navigating complex administrative requirements.

Currently, young people in residential facilities are required to first file a grievance with the institution before filing a lawsuit, and are not permitted to file for emotional abuse unless they are also claiming physical injuries.

The Justice for Juveniles Act would also exempt young offenders from the PRLA’s cap on attorney’s fees.

“Young people in justice facilities face a grave risk of solitary confinement, physical abuse, sexual abuse, and exposure to COVID,” said Jessica Feierman, senior managing director of Juvenile Law Center, a national children’s nonprofit organization. “Today’s win protects vulnerable youth bymaking it easier for them to seek help from federal courts.”

Gov. Tom Wolf has ordered an overhaul of youth facilities across Pennsylvania.

Pennsylvania’s Children and Youth Services agencies have no legal authority to require suspects to submit to drug and/or alcohol testing during investigations of child abuse reports, the state Supreme Court ruled Tuesday, siding with a prosecutor who had come under the scrutiny of a county child welfare agency.
The unanimous decision said the Child Protective Services Law does not “expressly or implicitly authorize collecting samples of bodily fluids, without consent, for testing.”
It was a win for Greene County District Attorney David J. Russo, who disputed the authority of the child welfare agency from neighboring Fayette County to require the tests. The agency was brought in to investigate complaints about Russo. He says no abuse has ever occurred to his children.
The county began investigating Russo based on a confidential tip that he had been intoxicated in public with one of five children, as well as an inaccurate claim he had been charged with spousal abuse. Russo was a lawyer in private practice when the investigation began. A Republican, he was elected district attorney in November. Russo has said forcing drug tests on Greene County residents who were the subjects of child-abuse complaints had become a routine practice before he challenged its legality. He said Tuesday that practice has apparently ended.

Fayette investigators interviewed all five of the Russo children while they were at school and were unable to confirm allegations against him,
the Superior Court said in a previous ruling. Russo warned in a court filing that drug testing of parents without probable cause “will inevitably lead to the forcible extraction of bodily fluids, the incarceration of parents for refusing to comply, or the exile of parents from their children.”

Berks CYS Admin on LEAVE!!!

The administrator of Berks County Children & Youth Services has been placed on administrative leave pending an investigation.
Krista McIlhaney has been placed on administrative leave with pay, according to county Solicitor Christine Sadler. She would not give the reason why Mc-Ilhaney was being investigated or comment further, citing county policy to not discuss personnel matters.
The Reading Eagle was unable to reach McIlhaney for comment.
McIlhaney became the administrator of Children & Youth Services in March 2016. According to her LinkedIn profile, her previous roles included vice president of business operations at Recovery and Wellness Centers and executive director of Luzerne County Children & Youth Services.
The county hired Mc-Ilhaney in 2016 following the retirement of longtime administrator George M. Kovarie, who retired in December 2014.

Family First Act

When we worked on the Family First Act it was intended to direct more money into keeping families together in the home and away from foster care and warehouse fostering.  We wanted to stop kids for cash and child trafficking through child welfare.
Since it's initiation politicians are trying to change the intentions of he Act to keep stealing children from their parents ongoing.  Call your legislators and make it clear that stealing our American children is unacceptable.  Tell them to force the Family First Act and keep our families together and provide all the help needed directly to the home and family.
