PLAINTIFFS’ MOTION TO OBJECT TO ORDER [Doc 207] RFERRING CASE TO MAGISTRATE JUDGE AND NON-CONSENT TO ANY PROCEEDING BY MAGISTRATE JUDGE – UNDER FRCP 73(b)(2)
Plaintiffs (Sanjay
Tyagi, Alka Jagatia and minor A.T.) object to Court Order
[Doc 207] referring this case to Magistrate Judge. Plaintiffs have never consented for trial by
Magistrate Judge and they object to any proceedings of this case by Magistrate
Judge under Federal Rules of Civil Procedure 73(b)(2).
U.S.
Constitution provides that people who file civil suits in federal court are
entitled to an "Article III Judge".
Plaintiffs insist on the Federal District Judge as their constitutional
right for all proceedings and withhold consent for any proceedings (trial,
final judgment and all post-trial etc) by Magistrate Judge.
